You're making it harder to believe you're really logical. Our government has three seperate branches for a reason, and if one can ignore the other in making laws, it doesn't bode well for the people.

Yeah, three branches, and there's nothing in this article that says Obama is treading outside his branch. In fact, it's right in the first paragraph:

the incoming administration is looking to reverse President Bush's executive orders on stem cell research, oil and gas drilling and other matters.

Executive orders, as in ones a president can make, and another president can unmake. Oil and gas drilling could fall under the Secretary of Energy, and stem cell research could fall under the Secretary of Education, though that one might be a stretch. Still, if Bush got away with it, no reason Obama can't.
