There is another problem. Pure, unadulterated smut is not covered by the First Amendment. In order to be covered, it must have "redeeming social importance". Where the hell are we going to get redeeming social importance?

Also, we're talking about the FBI in the second term of Bush after two terms of Clinton. Both administrations have been moralizing tyrants when it comes to pornographic material, no matter what you think of them otherwise you must admit that. What are we going to do if the FBI simply perceives itself as having the right to go in and investigate/prosecute (whichever shuts us down first) us with total disregard for the fact that we aren't harming anyone and Free Speech because we're "immoral filthmongers"?

Like I said, there are WAY worse things out there on the web than us, and you don't have to look hard to find it, either. Anyone who ends up here is looking for something very particular. We don't have popups or banners anywhere to attract traffic, because we don't WANT that kind of attention. This is a relatively small group of people here, and the more insular we keep it, the better it is.

Are newcomers welcome? Absolutely, but we don't need porn bots spamming the hell out of our message board.

This site isn't hurting anybody. We're not promoting violence, racism or sexism. We don't charge money for people to enter. The site is run totally by volunteers who give up their time and money to make this place happen.

Incidentally, if having an American server becomes a legal issue, then we just move to a Canadian one where we actually have freedom of speech.

One other thing, of the things that Rosie's facing charges for, several are not illegal. WS, scat, BDSM, threesomes, orgies, and slavery are not illegal in practice, so how can it be in literature?

I have a feeling there's probably more to that story than what we're being told. Unless a website is displaying illegal VISUAL material, it can't be charged. Fiction is intellectual property and is actually protected by copywrite laws, regardless of its content. Fantasy is one thing (ie. writing about having sex with an animal or whatever). Posting a picture of yourself enacting it is an entirely different kettle of fish, especially if the fantasy involves acts that have been deemed illegal.

I'm sure there are plenty of sites out there that harbor racist, sexist, or otherwise descriminatory sentiments in its viewers. I don't see how this could be considered to be on the same level as this site, which harbors nor encourages such narrow thinking. Fanfics about a children's anime series, regardless of their sexual slant, is an innocuous little thing compared to some of the truly hateful and harmful things you see on the web.

In the mean time, I don't see any use in borrowing trouble. Ok, rosie got shut down, but that's no reason for us to start looking over our shoulders.

I agree with you, except for the fact that Americans, particularly the government, aren't nearly as tolerant of things that offend them as you think. IMHO, Rosie was shut down for having erotic stories up JUST BECAUSE THE GOVERNMENT COULD, and perhaps because I don't know if Rosie had enough money for a lawyer to fight back.

I suppose the best we can do is avoid sticking our necks out.

I may be American, but it's not like I had a choice... And for reasons like this complete bull shit is why I, and all my friends, are anarchists. Yea, sure, we may have a couple freedoms, but if we don't follow it exactly how they want it, then they'll come down hard on us... But yea, I've hated Bush ever since he ran for president the first time, and I was 10 then, not having much knowledge of any of that shit, but whatever, it doesn't matter what they people say, just the rigged as fuck electorial collages. So much gay shit here to "protect" people... That's why I wanna move to Japan. So much more freedom there and you can do shit, and being an anime fan, original animes that haven't had the shit edited out of them... All in all, fuck Bush and the government.
