points for cleaver title, but i wanrt to get a point accross. I got banned for speaking my mind at #Dad (espernet) and thats a freedom protected my the US conisition. The dumbass ops banned me for that. If we all spoke our minds there, there will be no channel. Now, you wise-ass ops at the channel, kiss my ass! I want my freedom in the channel! Clean up your act.
well, you gotta realize, anything that goes on on the internet is based on a WORLD-WIDE network. sorry to say, but the US constitution dont mean shit to some kid who runs their own forums online.
Not necessarily. US law applies as long as the server is situated there. If it were really true that no law is valid on the web, it would become impossible for the police to shut down websites, and that's certainly happened often enough.

I havent seen what happened but if an op bans you on IRC, he has most probably a good reason to do so. Anyways, ops have, on most servers, the right to ban you WITHOUT any reason. Look at the espernet homepage (Epse.net)>>Rules II-A-5: 5. EsperNet is a privately owned and operated network. As such, EsperNet reserves the right to remove any person or bot from any or all servers for any reason.
speaking of espernets rules.. The ops have broken two.

-Sending repeated messages to a user or channel (flooding).
-Harassing users, e.g. through inflammatory messages.

Although rule 2, section II paragraph A says, "impersonating another user" HOW is that possible? only the REGISTERED user and NickServ know it. My repuatation was broken, as I was banned wrogly.
The Harrasing issue however, YES SLY, IM TALKING TO YOU! applys to everyone. Even if the Bot is out for a snooze. Harrasment can get you a-killed from the network. (i.e.: "If you dont shut up, ill guage your eyes out, take your heart and eat it, and il leave what is left for the coyotes) THAT is harrasment to the 4th power. Now that I stated my case.... Suggestions?
I don't know exactly what happened but I think I have seen something like this many times before. So the guy was harrassing you. First thing you should have done was go and tell the moderator. I was not there but if you did not do this and happened to try and lash bck in any way shape or form you simply added to the overall bad mood of the room, plus you made it so both sides (I am more of the type to give the benefit of a doubt, I do not believe you did anything until someone shows me proof) are not practicing basic internet etiquette.

If you are wondering about the free speech rules, true you can say anything you want, no one is stopping you. But if you do say something what most people do not want to listen to you are doing two things which are legitament reasons why to kick you:

A. You are being rude and impeding on others rights to have a nice clean room.

B. Even though it is not written, basic internet etiquette dictates that you will be nice and keep a room clean or you are agreeing that being banned is an okay option for you.

So, all in all those are more than enough reasons. Kinda like shouting "fire!" in a movie theatre, you simply don't do it but if you do you are agreeing that you will suffer the consequences. Common sense, pretty much. So, even if you did not start it (if you had lashed back at all) you are still at fault just as much as the one who supposedly started it.

If the person who kicked you was the one harrasing you then you should keep a recording of every single word said and complain to someone higher up. If they won't listen to you then the situation is out of your hands and you cannot do a thing about it but sit there and bitch. Last time something like this happened to me I had to go through 17 different screen names before the guy would even listen to me and tell me the password to my screen-name (he registered my name so I couldn't get on as that name). Now that I look back it wasn't worth the effort.
