Hmm...well...I try to go by oringality. I mean, if the pic isn't using the same candid, overused plot we've all seen at least a million times, then I'd say it's art. There are some exceptions, though. An example would be one of Karabiner's pics. Some of his work is straight up smut, but just from the artistic value that he put into it, it kind of makes up for it.
